Queensland says it's calling on federal authorities to determine if convicted mentally-illkiller CLAUDE JOHN GABRIEL can be extradited from New Zealand.

GABRIEL, who's 26, was seized outside a motel in Auckland last night and taken to asecure mental institution after motel staff recognised his photo in a local newspaperand called police.

GABRIEL was charged with murdering 17-year-old JANAYA CLARKE on the Gold Coast in 1998.

GABRIEL's parents, JOHN JONAS and ALESSANDRA GABRIEL are due to appear in court inBrisbane next Monday, charged under Queensland's Mental Health Act with allowing theirson to be absent from leave, knowing that he was a restricted mental patient.

Mr BEATTIE says it's not clear whether international laws covering mentally ill patientswill allow him to be extradited to Australia.
